Take-Two klaagt Jack Thompson aan

Vooruitlopend op de releases van Grand Theft Auto IV en Manhunt 2 heeft Take-Two besloten niet de aanklacht van Jack Thompson af te wachten, maar zelf het heft in handen te nemen en de advocaat in de beklaagdenbank gezet.

Take-Two heeft Thompson aangeklaagd wegens het schenden van hun rechten zoals beschreven in het First Amendment, het eerste grondwetsartikel in de VS. Hierin is onder meer de vrijheid van meningsuiting opgenomen. De rechtszaak is een reactie op de rechtszaak die Thompson aanspande tegen Take-Two om de game Bully in Florida uit te brengen, een zaak die Thompson overigens verloor.

De beargumentatie van Take-Two is als volgt:

Thompson has a history of making multiple threats of legal action, whether substantiated or not, both against Take-Two as well as the retailers who purchase the video games and offer them for sale to the public. Thompson has made such threats again in connection with Manhunt 2 and GTAIV…

Verder staat er in de aanklacht dat de constante stroom aanklachten tegen hun games van Thompson ertoe geleid hebben dat Thompson een private vorm van de Officier van Justitie van de staat Florida geworden is. Daarnaast wil Take-Two alle kosten die ze gemaakt hebben in verband met deze rechtszaken verhalen op Thompson.

Thompson wijst de aanklacht van de hand en wil tegelijk de eer opstrijken voor het verwachte ontslag van Take-Two CEO Paul Eibeler dat volgde uit de opstand van de aandeelhouders van Take-Two.
